Stepanova Y. Sentence Service Penal Principles as for Previously Convicted Persons Confined for a Specified Period.

The thesis is devoted to the problems of confinement execution for a specified period for previously convicted persons. The author has analysed the scientific research state issues related to implementation and execution of service sentences for previously convicted persons confined for a specified period, as well as the historical genesis of fixing it in the legislation. The concept and types of recidivism have been investigated; the connection between the social hazard gravity of recidivism and effectiveness of the remedial and re-socialization measures applied while serving sentences in penal closed institutions has been defined. Basing on the research results the conclusion on the necessity of taking into account criminal-legal, criminological and penal characteristics of previously convicted persons at all stages of sentence execution and their classification and typology as well has been drawn. A number of scientifically based measures aimed at reforming the penal principles of the activity, by changing current legislation as well have been developed in the thesis in order to strengthen the legal effect of the aforementioned issues and improve the execution and imprisonment sentence serving as for previously convicted persons confined for a specified period.
