Chornozub L. Criminal responsibility for avoiding punishment not connected with imprisonment.

This research focuses on criminal responsibility for avoiding punishment, not connected with imprisonment. Defined grounds such liability that is socially dangerous acts which appear to constitute a crime under Art. 389 of the Criminal Code of Ukraine, researched elements and characteristics of the offense conducted by separation from adjacent crimes set features qualifications. In addition, the theoretical description of criminal consequences evades punishment, not connected with imprisonment which may include both the vestinsg of criminal responsibility and sentencing as well as exemption from criminal liability or punishment. The study sets out proposals for amendments to the Criminal Code of Ukraine in order to improve the system of rules relating to liability for failure to discharge, and recommendations that can be used by courts in the application of the relevant rules in practice.
