Essay

Research object: public relations, which are in the process of emergence, modification and termination of the legal relationship in the field of management of lease Research purpose: elaboration of theoretical provisions and practical recommendations on improvement of legal regulation of leasing relations in management. Research methods: dialectic, formally logical, historical, comparatively legal analytical-synthetic, systematic and structured, logical-legal. The theoretical and practical value: is a comprehensive scientific study of the issues of legal regulation of leasing relations on the basis of which the appropriate scientific terms and proposals to improve the legislation in this sphere. The proposals formulated in the thesis, used in the activity of the Supreme Court of Ukraine, as well as in the training of judges of the Supreme Economic Court of Ukraine; accepted for use in the activities of the Notary Chamber of Ukraine; used in the educational process of Kyiv national Taras Shevchenko University. Scientific novelty: systematized scientific approaches to understanding essence of lease and peculiarities of its economic-legal regulation. Clarified the notion of rental property identifying its qualifying attributes. Reviewed normative-legal base of rental relations in management and developed proposals to address certain shortcomings. Defined specific characteristic of the lease with suggestions for clarification of its qualifying attributes. Reviewed and refined the subject-object composition of lease relations. Proposals to clarify certain provisions of the legislation of Ukraine, which define the basic obligations of the lease. Considered and fleshed out ways to protect the rights of the parties in matters of lease of the property. The features of selected operational-economic and penal sanctions in rental matters. Scope of use: subjects of legislative initiative, law enforcement, economic courts, business entities; institutions of higher education.
