Ptushenko D. Mistaken defense in criminal law of Ukraine

Identified common trends in the regulation of mistaken defense in comparative legal perspective, the main theoretical approaches investigated to determine the legal nature of mistaken defense. It was set the peculiarities of regulation mistaken defense by the Criminal Code of Ukraine, revealed its weaknesses. It was analyzed consideration of mistaken defense in enforcement practice, particularly in penal qualification and election activities of criminal legal effect. Based on the research made scientifically based concrete proposals on introducing amendments to the Criminal Code of Ukraine on improving regulation mistaken defense.
