Kalinichenko Y. The Criminal Responsibility for Deliberately False Denunciation about the Crime (Art. 383 of the Criminal Code of Ukraine)

This dissertation is devoted to researching the issues of criminal responsibility for deliberately false denunciation about the crime (art. 383 of the Criminal Code of Ukraine). The state of scientific research of the issue, historical overview of development of legislation of criminal responsibility for deliberately false denunciation about the crime are shown. The elements of crime, prescribed by the Article 383 of the Criminal Code of Ukraine have been analyzed: the object, the subject, the conduct, the mental state and the offender. The objective and subjective circumstances aggravating responsibility for deliberately false denunciation about the crime and problems of its punishment are considered. Based on the research propositions to amend and supplement Article 383 of the Criminal Code of Ukraine for its improvement had been made.
