Nevidoma N. The commission of a crime by an organized group

The problems of criminal liability for commission of a crime by an organized group under Art. 28 para. 3 of Criminal Code of Ukraine have been studied in the thesis. The history of development of criminal liability for committing crimes by an organized group has been considered and the main trends of group crimes at different historical stages have been discovered. The characteristics of committing crime by an organized group have been determined, the main relevant problems of criminal liability for commission of a crime by an organized group related to its legal regulation and qualification have been considered. Based on the conducted research, dissertation formulates justified recommendations to amend Criminal Code of Ukraine and to set out Art. 28 para. 3 in the new edition.
