The thesis is devoted to theoretical analysis of the legal legitimacy of state intervention in human rights in Ukraine. The notion of legitimacy of state intervention in human rights, which is proposed to understand as state action having the effect of limiting the respective rights and are necessary in a democratic society, maden in the legal and legitimate manner to preserve national interests, protection of persons and society and the rule of law. The author defines the content, scope and conditions of legitimacy of state intervention in human rights.
