The thesis is deals with the analysis of the nature and characteristics of legal regulation of dismissing employees for non-compliance with the position due to insufficient qualifications or health. The genesis, objective conditionality, the nature and significance of legal regulation of dismissing an employee for non-compliance with the position are studied. The features of qualifying employees and health state as criteria for determining the level of compliance with the position are elucidated. Procedures, conditions and legal guarantees during the dismissal of an employee for non-compliance with the position are found out.
