Sukhostavetz I. The legal regulation of state property lease

Research object: public relations, accordion in the process of origin, implementation, change and stopping of leasings legal relationships in the field of management. Research purpose: perfection of theoretical bases of the legal adjusting of lease of state property and development of suggestions in a legislation, directed on achievement of balance of private and public interests in this sphere. Research methods: dialectical, historical, legalistically-logical, comparatively-legal, system-structural, analytical and synthetic. Theoretical and practical value: it is the first in domestic legal science complex economic and legal research of lease of state property within the limits of which the row of new scientific positions is grounded and developed suggestion on perfection of legislation in this sphere. The results of the conducted research were taken into account in-process Committee on questions of economic policy of Supreme Rady Ukrainy during preparation of changes and additions in the Economic code of Ukraine, and also some Laws of Ukraine; utillized at practical activity of State property fund Ukraine and LLC "StilARM" at entering into the contracts of tenancy of state property. Scientific novelty: the provisions concerning the legal nature of the state property lease have been specified in the, the thesis history of formation and development of legal regulation of state property lease have been researched. The situations of subjects and objects of state property lease have been analyzed. The problematic issues connected with the conclusion, performance and termination of the contract of state property lease have been researched. The necessity of improvement of legal regulation in the sphere of state property lease has been substantiated. Procedure of carrying out the control in the sphere of state property lease and procedure of involving to liability for violations in this sphere have been researched. Proposals on improvement of legal regulation of carrying out the control in the sphere of state property lease and procedure of involving to liability for violations in this sphere have been proposed. Sphere of the use: subjects of initiation of bill, subjects of legislative initiative, management subjects; higher educational establishments.
