Pelypenko O. The pledge of corporate rights.

The thesis is devoted to research of the legal regulation of pledge of corporate rights. The possibility of corporate rights to be the subject of pledge relations has been proved. The comparative analysis of corporate rights, moral rights, and requirements that are of personal nature has been conducted, and their different legal nature has been determined. Special attention was paid to the specific conditions of the corporate rights pledge agreement. The different ways of evaluation of corporate rights were described. A comprehensive legal analysis of the existing ways of enforcement of the corporate rights under the pledge has been done and the most effective of them were determined. Also in this part there have been theoretically justified the proposals to improve the current legislation of Ukraine. There have been proposed the draft amendments to the current legislation, which define the procedure for exercising of the rights and obligations of all the participants of pledge relations, where the corporate rights are the subject of such relations (creditor-mortgagee, company member - mortgagor, other members of company, company).
