The dissertation is devoted research of problems of the сriminal responsibility for gambling business activity. The theoretical positions, concerning сriminal responsibility for gambling business activity are protected. Objective and subjective signs of this crime are researched. It is alleged that the subject of criminal influence in the standards provided for in аrticle 203-2 of the Criminal Code of Ukraine performs exactly the order established by the state of economic activity in terms of the ban on gambling business activity, organization and conduct of gambling, which serves as the main direct object of the crime. It is argued that there is such a new phenomenon as mental Sports, which owns a significant number of table games, some of the card games and gambling are also sports Title: bridge, poker, backgammon. To remedy this situation, you need a separate explanation for the law enforcers that the organization and conduct of officially recognized at the national and international level sports card games can not be qualified as the organization and conduct of gambling. With a new perspective formulated terms characterizing gambling activity as a socially dangerous act, namely, "gambling", "gamble", "gambling activities", "gaming". Analyzes the problematic issues of employment relations with gambling related crimes of the Criminal Code of Ukraine. It is proposed to amend the Criminal Code of Ukraine in order to improve it. In particular, the proposed new wording of articles on gambling session in the Criminal Code of Ukraine and amendments to the Law of Ukraine on May 15, 2009 № 1334-VI "On the prohibition of gambling business in Ukraine".
