Kalashnyk O. Gaps in civil procedural law and their elimination

This dissertation is devoted to the research of the gaps in civil procedural law and ways to eliminate them. In this dissertation made the historical overview of identification and elimination of gaps in different historical periods by various scientists and practicing lawyers. Also, analyzed the procedure codes of a number of foreign countries in Romano-Germanic legal system, it was concluded that the vast majority of them using such method to overcome gaps in civil procedural law as an analogy. Given the definition of the gap in civil procedural law, identified a number of characteristics of gaps in the civil procedural law.
