Sytnik O. An agreement on domestic contract according to the civil legislation of Ukraine

The dissertation is a complex research of the problems of legal regulation of relations under the agreement on domestic contract. The historical periods of formation and development of legislation on agreements on domestic contracts are considered. The peculiarities of legal regulation of contracting domestic relations are disclosed, the peculiarities of the mechanism of legal regulation of the studied relations are determined. The dissertation defines the concept and characteristics of the agreement of domestic contract; the subjects, rights and obligations of the parties of it are researched; the procedure of the conclusion and features of the implementation under the agreement on domestic contract are analyzed. In the dissertation the most effective ways of providing of the implementation of the commitments under the agreement on domestic contract, such as penalty, surety, deposit, mortgage and retention, are established. In the dissertation considerable attention is devoted to the research of essence and types of breach of the agreement on domestic contract, on the basic of what their classification is made. The peculiarities of civil liability of the parties for breach of the agreement of domestic contract are established. The theoretical proposals and practical recommendations for improving the current legislation and judicial practices in contracting domestic relations are developed.
