Serohin S. Abuse of right in corporate relations (comparative approach).

The thesis is an independent accomplished comprehensive academic comparative research on theoretical and practical issues of legal regulation of prevention the abuse of rights in corporate relations. The research is intended to generalize theoretical achievements made in private law, analyze different legislative approaches on the mentioned aspect of relations. The author defines factors of development and distinctive features of legal regulation, discloses the characteristic features of development of legal regulation of prevention abuse of rights as well as ways of perspective improvement national regulation in this sphere. The particular attention is paid by the author to the analysis of system and approaches exist in doctrine, legislation and arbitration practice in civil law tradition countries to settle substantive problems of prevention the abuse of rights in corporate relations. The research substantiates the scientific conclusion regarding improvement of particular rules of Ukrainian legislation based on generally recognized world practice in legal regulation of prevention the abuse of rights in corporate relations, national peculiarities and priorities.
