The thesis is devoted to the research of theoretical and legal aspects of democracy as a phenomenon of legal reality, therefore methodological bases of studying democracy are researched, and the principles and functions of democracy are defined, etc. Justifying democracy as a phenomenon of legal reality it is mentioned that legal reality is an objective (real) condition of existence of all legal phenomena of social life regardless of the level of their development (formedness).
