In the thesis are analyzed the main conceptual approaches to the definition of the right to information as a fundamental human right, the role and the place of the right to information in the system of human rights and fundamental freedoms and in the formation of a law-governed democratic state in the formation of modern national legal system of Ukraine are grounded. The right to information is researched in the context of the establishment of the foundations of the information society the increase of the volume and value of information for the functioning of a modern state. The expediency of the assignment of the right to information in its modern form to the third generation of human rights on the basis of historical conditions, characteristics of development and functionality is determined. The legal framework of governing the right to information in Ukraine, the principles of information and legal relations, the experience in regulating the right to information in international legal documents are revealed; a comparative legal analysis of securing the right to information in democratic countries and countries that are on the path of democratic development the guarantees of its implementation, of the reasons for constraints and the framework of governing such restrictions is conducted. The necessity of improving the mechanism of realization of the right to information is grounded: elimination of deficiencies and in consistencies of regulations that govern the implementation of the right to information in Ukraine.
