The thesis is devoted to the research of the burden of proof in civil proceedings in Ukraine, Republic of Poland and Russian Federation. It is argued that the knowledge and proving are related only to certain parts, and evidentiary activities features should be found in the construction of the burden of proof. The purpose of proving is a factor of forming the subject matter, methods, tools, object and extent of evidence.
