The dissertation research touches a study of theoretical and applied aspects of role of judicial practice in today's law-making process, the establishment of the concept's features, signs and essence of judicial practice and its functional setting in the modern terms of perfection of legislation. In the dissertation the practical role of judicial practice is determined in a today's law-making process. Judicial practice is determined as the special type of legal activity which is carried out by the authorized subjects at national or international level under a regular legal procedure with the purpose of administer justice or official interpretation of legal rules. The special attention applies to the problem of understanding of essence of judicial practice. This problem is exposed within the limits of social; legal; logical; imperious; subject; formal; object; public and judicial aspects.
