Essay

The dissertation is devoted to the comprehensive research of civil-law regulation of relations coming from rendering help to a capable physical person with exercising her rights and performing her duties. Rendering help to a capable physical person with exercising her rights and performing her duties is considered to be a civil-law instrument, by means of which a person can compensate for some lacking abilities that are needed for independent participation in civil transactions. Legal rules on rendering help to a capable physical person are considered to constitute a separate sub-institute of civil law as well as tutorship and curatorship. It is stated that relations between helper and the person, to whom help is rendered, are of contractual nature. The contract for rendering help to a capable physical person with exercising her rights and performing her duties is defined and characterized. Essential terms, the formation procedure, form and termination of the above mentioned contract are specified. The duties of parties to the mentioned contract are designated.
