Illiashenko O. Prevention of the illegal trafficking in human organs and tissues in Ukraine and other European counties (comparative and juridical research).

The dissertation is the complex criminological research of the prevention of illegal trafficking in human organs and tissues in Ukraine and other countries. The analysis of the state of scientific researches concerning the problem of preventing of trafficking in human organs and tissues, is examined in this dissertation. The legislation concerning the criminal and legal protection of the transplantation was analyzed and the necessity of the usage of international experience in this sphere has been proved. The analyses of the criminological features of the prevention of trafficking in human organs and tissues has been carried out, the individuality of the offender and the victim have been examined and determinants of the crimes have been studied. The scientifically grounded measures concerning the prevention of the trafficking in human organs and tissues in Ukraine have been developed and they are complex of societal and special criminological measures of moral, educational, economic and legal character, and they have, first of all, very clear applied aspect. Several amendments to the criminal legislation have been proposed with the aim of improvement of the protection of citizens from the crimes, provided by the article 143 Criminal Code of Ukraine. In the result of researches methodological recommendations and propositions have been developed and they have been introduced to the legislative, educational and practical process.
