Borshchevska O. Terms in commercial legal proceedings

Research object: social relations that arise during the implementation of the rules on deadlines in the process of justice delivery in economic proceedings. Research purpose: to develop new theoretical propositions about the timing in economic proceedings and justification of proposals for changes and amendments to the commercial procedural legislation of Ukraine. Methods of research: dialectical, analytic-synthetic, historical-legal, systemic-structural, formal-logical and logical-legal, comparative-legal. Theoretical and practical significance: deepened and refined theoretical developments related to the legal regulation of time, aimed at addressing development issues in Ukraine, economic procedural legislation and practice of its implementation. The provisions of the thesis were used to improve existing legislation and enforcement Anan district court of Odessa region, in the LLC "Odessa production Association "dry cleaning", in the educational process of the Odessa national University I.I. Mechnikov of Ministry of education of Ukraine. Scientific novelty: the proposed definition of the term in economic proceedings (economic procedural term). Improved classification of the calculation of terms in the economic proceedings. In dissertation was analyzed the principles of economic justice according to the calculation of terms in the economic proceedings and functions of the calculation of terms in the economic proceedings. It is studied the concept and the common rules for calculation of terms in economic proceedings. It is found features of missing, restoration, extension, suspension, resumption and termination of proceeding in economic proceedings, we was delineated the concept of "deposition of the case" and "a break in the court session". It is investigated features of procedural deadlines in dealing with economic cases in the first instance and when viewing the judicial acts of economic courts. We have also made proposals to improve the provisions on of calculation of terms in the economic proceedings in Ukraine. Scope of use: the subjects of legislative initiative; the economic courts, economic entities; institutions of higher education.
