Bohonyuk H. Criminal legal characteristics of non-fulfilment of the judicial decision

It has been established that the concept of «crimes that consist in nonfulfilment of the judicial decision» unites crimes under articles 382, 388, 389 and 389-1 of the Criminal Code of Ukraine. The discrepancy between sanctions of articles of the Special Part of the Criminal Code of Ukraine, which provide criminal penalties for non-fulfilment of the judicial decisionon compliance with the ratio of degree of severity of certain types of penalties specified in sanctions of simple and qualified elements of crimes, has been proved. The disadvantages of the system of punishment for crimes that encroach on the order of a judicial decision have been represented.
