Yashchenko S. Criminal responsibility for deliberate non-execution of agreement on reconciliation or admission of guilt

It is particularly established that a person, convicted as per the agreement on reconciliation or admission of guilt and Article 389-1 of Criminal Code, commits a crime if there are characteristics of special recidivism in accordance with the agreements. This type of recidivism is a new one among those types which division comes down to the character of the crime. The recidivism is there where the person, convicted for the deliberate crime as per the agreement on reconciliation or admission of guilt, commits a new crime again in accordance with the article 389-1 of the Criminal Code of Ukraine. As a result of the research including the positive experience of foreign countries the propositions with regard to the Article 389-1 of the Criminal Code of Ukraine are made by improving and adding to the context.
