The thesis reveals a number of issues that give a comprehensive picture of private-legal (civil and commercial-legal) regulation of trade relations in Germany. Based on the history of commercial law in Western Europe in general and Germany in particular, was singled out and described the classic signs of commercial law of the state, which is characteristic of it today, and explained the reasons for preserving the dualism of private-legal regulation of these relations in Germany today.
