The concept, content and purpose of international legal standards of the United Nations and the Council of Europe in the field of convicts' rights defense are exposed. The analysis of the compatibility of national legislation with the requirements of international legal standards for the convicts' rights protection as for the elements of enduring the punishment regime has been performed.Suggestions to improve the penal legislation of Ukraine, sectoral legal acts in the field of convicts' rights defense are given.
