Panchenko I. Recognition of ownership as a mode of protection of civil rights.

The dissertation is the first in the science of civil law of Ukraine special complex research of recognition of ownership as a mode of protection of civil rights. Based on the analysis of acts of civil legislation, scientific works and court practice the concept, nature and system of civil legal modes of protection of ownership are defined, the legal nature and peculiarities of the claim for recognition of ownership as a mode of protection of civil rights is researched, the structure of art. 392 of the Civil Code of Ukraine, the issues of impact of the limitation period on this claim were analyzed. The legal nature, subjects and possible features of claims on recognition of ownership over objects of unauthorized construction, claims on release of property from arrest, claims in the order of succession and under aquisitive prescription were defined. Scientifically based suggestions for improvement of civil legislation regarding the application of the recognition of ownership as a mode of protection of civil rights were formulated.
