Gud T. Criminal Liability for Concealment of a Crime (Art. 396 of the Criminal Code of Ukraine)

This research focuses on issues related to the peculiarities of criminal liability for previously not promised concealment of a crime. The genesis of criminal responsibility for this type of involvement in a crime is considered according to the national legislation. The similarities and differences in foreign law legal regulation of the responsibility for this deviant behavior are specified. The social, psychological, criminological and regulatory factors of criminalization of previously not promised concealment of a crime are studied. The objective and subjective components and elements essential to a crime under Art. 396 of the CC are analyzed; the separation from other related crimes is performed; and peculiarities of committed crime qualification are also observed. The suggestions and recommendations related to improving the provisions of Ukrainian criminal legislation and its practical application are formulated.
