Ponomariova T. The release of minors from punishment and its serving in Ukraine and Poland: comparative analysis

In the dissertation the main aspects of the release of minors from punishment and its serving in Ukraine are researched. The history of the institute of the release of minors from punishment and its serving in these countries, concept and foundation of this release are studied; the conditional and unconditional release from punishment and its serving in Ukraine and Poland and legal consequences of such release are analyzed. It is proved that, the current version of certain provisions mentioned down in articles 104-107 of the Criminal Code of Ukraine does not fully correspond to modern views on the legal regulation of the release of minors from punishment and its serving and it needs immediate revision in the context of which Poland experience is very valuable. The author points out the necessity of creating a separate legal act concerning the order of appointment and dismissal of the punishment for minors. Based on the study a number of theoretical conclusions and suggested proposals to improve juvenile institution exemption from punishment and its serving are made.
