Oksaniuk N. Principles of inheritance in Civil Law of Ukraine

The unified concept of inheritance principles of civil law in Ukraine was developed in the thesis. Epistemological and historical background of the emergence and development of the principles of inheritance has been discovered at different stages of historical development of the legislation in accordance with legislation in force in the Ukrainian lands from the tenth century to nowadays. The concept, characteristics and types of inheritance principles in civil law and their implementation in hereditary relationships, the main criterion for their classification has been defined. The features of the practical implementation of sectoral, sub-sectoral and institutional principles of inheritance has been developed, also formed proposals and recommendations to improve regulation in the research area. Finally, the author states the propositions to change the Civil Code of Ukraine in terms of empowering minors the right to refuse or withdraw heritage submitted an application for the inheritance without the consent of parents or fiduciary; ability to change priority of invocation to inheritor in law not only the agreement of heirs but also application one of the heirs.
