Essay

The thesis deals with the right for the usage of someone's else land area with the agricultural use (emphyteusis). Emphyteusis is an object of analysis in the Roman private law, the civil legislation of Ukraine, the law of Western European countries. In this thesis the problems of emphyteusis, its specific judicial indications are researched and definition of the emphyteusis is given on the basis of analysis of science literature, national legislation and drafts of normative and legal acts of Ukraine and other countries, practice of law enforcement bodies.
