Skok O. Crimes of limited gravity and criminal liability issues

Dissertation is dedicated to the problems of criminal responsibility for the low severity crimes. Namely, the following issues were considered: historical background of separating low severity crimes into specific category; dogmatic provisions of the compulsory elements of the crimes of the category being considered; foreign legislation regarding the place of low severity crimes or actions having the characteristics of low severity crimes in the above mentioned legislation. The place of low severity crimes in legislative classification is defined, and the comparison of low severity crimes with the criminal offense, misdemeanor, administrative infraction and other penal actions. The peculiarities of the concept and characteristics of low severity crime and the issues of execution of the responsibility for these crimes are discussed. Comparative legal analysis of the CC, CPC and CEC of Ukraine, the draft law of Ukraine "On amendments to several legal acts of Ukraine concerning execution of criminal offence" No. 2897 as of May 19, 2015. The range of proposals regarding the improvement of the criminal and criminal executive legislation is offered including the proposal concerning optimization of the criminal responsibility for the commitment of low severity crimes.
