Essay

The thesis is first in Ukraine special complex research of factors' influence of Orthodoxy on the modem criminal policy in the Ukrainian legal field. The significance of religious and legal doctrine in the Ukrainian criminal policy was justified. The measure and extent of the influence that Christian Orthodox religion had on criminal law politics in the domestic law at different stages of historical development of the state and law was set. The system of socio-cultural determinants of separate institutions of Ukrainian criminal law in their connection with morality and theological dogmas of orthodoxy was determined. The effectiveness and expediency of alternative forms of realization of criminal responsibility and non-punitive activity, which are based on the ideas of Orthodoxy creed were argued to provide positive dynamics of correction and resocialization of persons, who committed crimes. The concept of reasons of deviant behavior based on biblical teachings' point of view about sin was justified. The concept of spiritual security of society and the necessity of strengthening its criminal protection were characterized.
