Essay

The thesis constitutes an independent and complete treatise that provides new theoretically founded results. The results of the research solve the scientific task which consists in identifying theoretical and practical issues related to legal status of financial institutions as participants of the financial services market. Also the thesis elaborate theoretical foundations of modeling of organizational legal forms of financial institutions and provides on the basis thereof some recommendations for improvement good law in this realm. The thesis considers legal structure of an organizational legal form of financial institutions as a legal mechanism for reconciling economic and legal interests of the participants to financial services market. Economic and legal characteristic of the financial services market is provided; functional economic and legal system requirements for the participants of this market are disclosed; organizational legal form as a concept of commercial law is examined. Also the author pays attention to general and specific functional requirements imposed on organizational legal forms of financial institutions and analyses special features of organizational legal forms of some particular types of financial institutions, namely: credit union, collective investment scheme (corporative and mutual investment funds), asset management company, and non-governmental pension fund. The thesis contains suggestions for improvement of good law, in particular the following Laws of Ukraine: "On Collective Investment Institutions", "On cooperation", "On Joint tock Companies", and "On Credit Unions".
