Lillemiae O. Legal regulation of state aid to undertakings

Research object: social relations associated with the provision of state aid to business entities.: Research purpose: development of theoretical provisions regarding economic-legal support of the state aid system to business entities subject to the rules of EU law and the WTO. Research methods: dialectical, formal logical, historical, comparative legal, analytic-synthetic, systemic-structural, logical-legal. The theoretical and practical value: deepened and refined in the theoretical science of economic law of the development of economic-legal support of relations in the sphere of state aid to business entities. Proposals are accepted for use in law-making activities of the Verkhovna Rada Committee on industrial policy and entrepreneurship, activities of OP "Atomrepairservice" SE "NNEGC "Energoatom", the Poltava regional territorial office of Antimonopoly Committee of Ukraine. Scientific novelty: the article analyzes the concept of "state aid to business entities" and law of Ukraine on state assistance to economic entities, identifying key historical periods of formation of system of legal regulation of the studied relations. Consider the forms of state aid, determined by the ratio of state aid and public procurement. Analyzed legal measures to ensure the admissibility of state aid to business entities benefits of horizontal state aid. The procedure for the granting and control of the permissibility of state aid to business entities. Identified the General and special conditions of application of EU law and WTO in the field of state aid to business entities and clarified the correlation of legal regimes of state aid in EU law and subsidies in WTO law. The author defines perspective directions of adaptation of Ukrainian legislation to EU legislation in the field of state aid to business entities.
