Smolyar O. State and public control in local self-government.

In the reserch a comprehensive scientific research of state and public control in local self-government was made, was founded a number of conceptions, theoretical propositions and conclusions, practical recommendations for improving the legal control regulation on activities of local self-government officials. Author analyzed control systems on municipal activities in foreign countries, competence of the supervisory bodies and forms of its implementation and developed the proposals for borrowing positive foreign experience. Dissertation analyzes the control in local self-government as a form of social control. Control is a system of inspection by authorized entities (public authorities, civil society) and the activities of local self-government officials through monitoring of law violation, non-compliance of the results compare to the objectives; warning of possible deviation in their work, eliminating the causes that give rise to such non-compliance, and negative effects. The paper stated supervisory powers of local communities and forms of public participation in monitoring activities of local self-government bodies and officials. The author proposed to create a municipal ombudsmen institute in Ukraine. Aforesaid ombudsman should be elected by the people, to protect municipal rights of citizens and control over the activities of local self-government officials. The author suggests regulating the procedure for public monitoring of the activities of local government on legislative level.
