TThis research focuses on issues of criminal law characteristics of threats or violence against a defense attorney or person. Defended theoretical provisions concerning criminal liability for threat or violence against a defense attorney or person. The author investigated objective and subjective features of this crime. With a new perspective author argues the need to legislatively consolidate the provision of criminal legal protection not only advocates, representatives of the person (both physical and legal), but also legal representatives, regardless of the industry (criminal, administrative, civil or economic) in which the activities of legal assistance. Specified and formulated on a new meaning concept of threat on defense attorney or person. The author formulated on a new meaning of violence (physical) in the criminal law sense. The author argues that as the motive of threats or violence against a defense attorney or a person may act as revenge for the execution of activities related to the provision of legal aid in the past. Analyzed issues threats or violence against a defense attorney or a person with related crimes Criminal Code of Ukraine. Proposed amendments to the Criminal Code of Ukraine on its improvement. In particular, the proposed new wording of item threat carried or violence against a defense attorney or a person in the Criminal Code of Ukraine and other criminal law.
