Gotsanyuk O. Transferability of property rights on industrial property objects.

The dissertation is devoted to the research of transferability of property rights on industrial property objects according to legislation of Ukraine. Modern theoretical concepts of property rights on industrial property objects are analyzed, kinds and content of such rights are determined. Content of integrative concept of intellectual property rights as the one that completely discloses issues of its nature is considered. Properties of industrial property rights that provide its transferability are determined. These include apartness, alienability, value, validity and usefulness. Direct and indirect transferability of property rights on industrial property objects are differentiated. Legal mechanisms of civil circulation as well as mechanisms of origination, transfer and restriction of such legal rights are researched. Mechanism of deprivation of transferability of property rights on industrial property objects is analyzed. Legal nature of restrictions of industrial property right as well as restrictions of industrial property right transferability is described.
