Essay

The made a comprehensive scientific study of human rights as an object of constitutional and legal regulations, which proved a number of conceptions, theoretical propositions and conclusions, practical recommendations for improving the legal regulation of the rights and freedoms at the constitutional level. Institute of Human Rights and Freedoms understood as a system of basic standards and principles which reflected the constitutional and legislative level, regulate and protect relations between the state and the individual, the legal status of a person to determine its place in terms of implementation and guarantee of rights in relations with the state, communities and individuals in the process of meeting their needs and interests. It is paper, the content of modern theoretical approaches to the understanding of rights and freedoms, including the functioning and structure determination of regulating the grounds and procedure for their use, and a new approach to this legal institution and build it in line with international and European standards. Were further developed arguments for invalidity offers consolidation in the Constitution of Ukraine provisions for use in case of conflict the international legal obligations of Ukraine and the regulations generally recognized principles and rules of international law.
