Polishuk M. Mediation as a civil disputes resolution method.

The thesis deals with the application of mediation in civil matters and legal regulation of this procedure in different countries. The general scientific approaches to understanding the categories of alternative dispute resolution, mediation, mediation principles, types of mediation and mediation models have been analysed. The mediation has been differentiated from other alternative dispute resolution methods, such as arbitration, negotiation and conciliation. The nature of mediation procedure has been defined. The main characteristics of mediation, such as participation of mediator, who cannot decide for the parties, but rather encourages them to agree to a settlement, voluntariness and confidentiality, have been described.
