Essay

The thesis is devoted to exploring the civil legal status of local communities as the subjects of the civil law. The concept and the variety of local communities which can be the participants of civil legal activities are determined; the main factors that cause the specificity of local communities as the subjects of civil law and their role in the system of subjects of civil law are identified; their distinctive features which make them different from the rest of civil law subjects are outlined; the nature of their civil law entity is characterized. Specific attention is dedicated to the local communities as the subject of property law. In particular, the retrospective analysis of establishment and development of communal property is conducted; the definition and the nature of the communal property law is provided, the difference between the communal property law and other types of property rights are highlighted, the features of legal rights, that form the communal property law are defined. The features of local communities' participation in civil obligations, which are divided into contractual and non-contractual in the dissertation, are investigated. The scientific and practical recommendations for further development of legislation that regulates the civil relations are substantiated.
