Sosnina O. Criminal liability for personal privacy (Art. 182 of the Criminal Code of Ukraine)

The thesis is a complex scientific research of problems of criminal liability for personal privacy (Art. 182 of the Criminal Code of Ukraine). Thesis summarizes the historical and foreign experience of the criminal law protection of privacy, as well as the respective case-law of the European Court of Human Rights. Conducted is the legal analysis of the basic and qualified formal composition of a crime, foreseen by the Art. 182 of the Criminal Code of Ukraine, as well as sanctions, foreseen for the commissioning of a crime; held the separation of the privacy violations from the acts with an adjacent composition of a crime. Based on the results of the study are formulated theoretical conclusions and proposals for improving the legislation of Ukraine on criminal liability for personal privacy and its practical application.
