The thesis contains a complex research of discretionary powers. The paper analyzes the genesis of the emergence and development in the science of civil law. Based on the analysis of different points of view regarding the legal nature of discretionary powers, separate theories of discretionary powers are derived. Much attention is paid to discretionary powers, which arise in civil relations not related to the obligation. In particular, we consider the rights arising from joint ownership, co-authorship, and corporate legal relations. Also analyzed judicial practice of disputes related to discretionary powers.
