Morozova Y. Civil legal regulation of leasing commercial premises and buildings.

This research focuses on theoretical and practical problems of legal regulation of civil lease commercial premises, buildings and structures. Established two models of the lease of non-residential premises, buildings, for the legal nature: 1) binding model that relates the lease of non-residential premises, buildings, facilities solely for the Law of Obligations (applicable to this contract if he signed three years); 2) a comprehensive model that considers lease commercial premises, buildings, structures as complex formation, obligations and property law (applicable to this contract if concluded for a term not less than three years). Formulated the definition of "capital structure" within the meaning of Civil Code of Ukraine as an object that has a foundation bind to land and related building characteristics that enable operation of the facility for more than thirty years.
