Bukach M. Criminal liability for not fulfilling a court decision

The thesis deals with the problems of criminal liability for not executing a court decision. The question of conformity of the investigated norm to the bases and principles of criminalization of socially dangerous acts is revealed in this work. The comparative legal analysis of the legislation of foreign countries regarding the criminal liability for committing crime is carried out. The criminal and legal characteristic of the objective and subjective signs of non-fulfillment of the court decision is carried out. The forms of the criminal liability and other criminal and legal measures for committing the crime in accordance with Article# 382 of the Criminal Code of Ukraine are described. As a result of the research, taking into account the positive experience of foreign countries the proposals to improve the current legislative Article# 382 of the Criminal Code of Ukraine by making appropriate changes and additions in its content are formulated.
