Briukhovetska M. Civil Law Regulation of Posthumous Donation in Ukraine

The thesis is complex scientific research of civil law regulation of posthumous donation in Ukraine. The analysis of the state of the scientific elaboration of the problem of civil law regulation of posthumous donorship is made, the methodology of conducting such research is outlined, the genesis of the legislation that regulates the order and features of the deceased organ removal is traced, the experience of foreign countries in the specified field is studied. The essence, criteria and principles of posthumous donorship are determined, its types are distinguished. The composition of legal relationships and grounds of their origin is studied. Civil liability of medical workers for offences in the field of posthumous donorship is identified.
