Mukhamedzhanova A. Criminal and Legal Characteristics of Violence against Population in the Area of Military Operations (the Art. 433 of the Criminal Code of Ukraine of Ukraine)

The author has traced the genesis of the norm on liability for the acts of violence of military servicemen against civilians and has proved that such regulations like the Art. 433 of the Criminal Code of Ukraine emerged in the national legislation in the XVI century and existed in most significant legal documents that regulated criminal and legal relations on the territory of the current Ukraine. The author has provided characteristics of a special subject of violence against the population in the area of military operations - it is a sane individual, who has reached 18 years, eligible for military service on health grounds and is in military service in the Armed Forces of Ukraine or other military formations established in accordance with the laws of Ukraine. The content of the features of the mens rea under the Art. 433 of the Criminal Code of Ukraine has been considered.
