Essay

The thesis is devoted to complex research of the legal status of Transcarpathia as a part of Austria-Hungary (1867-1918 years). This work is based on historical, formal legal and comparative research methods and helped to clarify the constitutional nature of Austria-Hungary as confederal creation and parliamentary monarchy, the Hungarian kingdom place within the dualist monarchy and concluded on the specifics "of the constitution of Austria-Hungary." Particular attention is paid to the analysis of the content and scope of the concept of Ukrainian lands (Transcarpathia so-called "Hungarian Rus") for the period 1867-1918 years due to constitutional order in Hungary and Austria-Hungary. The thesis concludes that the period of stay in Transcarpathia in the field of Hungarian and Austrian legal tradition combined strengthening European legal values (the rule of law, democracy, secularism), on the one hand, the adverse social and legal conditions for the preservation and development of Ukrainian national identity of on the other hand.
