The thesis is an independent research and complete, containing new theoretical results proved that together solve scientific challenges is to develop a scientific theoretical approaches and concrete legal measures economic freedom of business. Thesis deals with the current state of legal means of ensuring freedom of commercial entities. The paper substantiates the idea that freedom of commercial entities acting as a legal goal in the relations of legal economic order that is to provide the necessary and sufficient variation in the behavior of economic entities within which sold and reproduced entrepreneurial motivation. The author found that freedom of commercial entities in positive-legal sense be regarded as a legal regime for realization of economic activity that defines the method of economic market by ensuring the coordination of private interests on the basis of discretionary. And analyzed legal means to guarantee freedom of the nature of commercial entities by the type of legal elements.
