Katynska L. Electronic form of transaction (comparative analysis of legal regulation in Poland and Ukraine)

The thesis is dedicated to complex research of legal regulation of transactions in electronic form in Ukraine and Poland. Having analyzed the studies and current legislation in both Ukraine and Poland, the author provides the definitions of terms: "electronic transaction", "electronic document". Furthermore, the author proposed to establish the concept of documentary form of transaction in the Civil code of Ukraine. The notion of electronic signature and its varieties is analyzed. Author outlines the features and functions of the electronic signature. Moreover, the legal regulation of electronic signatures in Poland and Ukraine are studied. The ways to improve the legal regulation of electronic forms of transaction by formulating a number of amendments to the Civil Code of Ukraine and the Law of Ukraine "On Protection of Consumers' Rights" are proposed.
