Shyian O. Criminal liability for misuse of budget funds, for budget expenditures or provision of credits from the budget without determined budget purposes or with their excess

The thesis is devoted to the complex law research of the criminal liability for misuse of budget funds, for budget expenditures or provision of credits from the budget without determined budget purposes or with their excess. The history of development, social dependence and international experience concerning this crime were studied. On the grounds of the study of legislation, theory and practice on the thesis topic the objective, subjective and qualifying features of the crime established under Art. 210 of the Criminal Code of Ukraine were described; the crime was separated from other crimes; the peculiarities of the measures of criminal law nature applied for this crime were considered and summarized. In terms of this, the relevant provisions of the criminal law theory were developed, on the basis of which the concept statements on improving of the legislation of Ukraine and the practice of its application regarding the crime established under Art.
